The Crysanthemums by John Steinbeck

I have chosen to work with â€Å"The Chrysanthemums† by John Steinbeck for this assignment, I have found this short story to be fascinating and it brings with It emotional undertones which remain with the reader long after reading. In the essay I will be demonstrating how the author has used both tone and style and symbolism to convey the principles of the work. Tone and style can be found in the method of writing and narration.Tone is Indicated by the style the text Is written, who the narrator is and it will establish the reader's relationship with the character's. Style Is the distinctive use of language, It Is the sum of the dictation, Imagery, syntax, grammar, punctuation, and figurative language. Often the style of writing can platoon who the writer Is. Symbol (or symbolism) In writing can be a person, time or place. Something that suggests meanings beyond the literal sense, It bears multiple suggestions and associations and Is unique to that particular work.This story i s written in third person narrative, there initially appears to be no emotional pull in the way the story is told though it is rich in descriptive of place ND setting, from this you get a sense of being hemmed in, an atmosphere almost of despair. Despite the fact that no real emotional ties seem to be present at first glance, and maybe because of this fact the reader is left to feel the emotional undercurrent.I feel that the author has more invested in the emotions of this piece and this puts it at odds to the narrator. There is some speculation that this story is in fact based on John Steinbeck relationship with his wife Carol (Satinwood, 2008) and alludes to a short affair she had with a friend of Steinbeck wife's boss. Throughout the story we get to know Elise Allen, her dreams and desires are laid bare not so much through thought or words but by her actions and her surrounds.Elijah's conversation with her husband Henry Just adds to the impression that she is a woman who wants to be thought of and treated as a woman in all aspects but through lack of communication with Henry she feels helpless and a bit like ‘one of the boys'. Is her only quality of value the ability to grow things? Henrys insistence that she should turn her hand to the orchard (far more practical) than her beloved harassments Just reinforces his inability to see her as a sexual being. Her sexuality is played down.The story comes full circle with Elijah's dissatisfaction with her life, the idea of escape or a connection, though not sexual to another person who seemed to have an interest in her and her work gives her a peek Into what could be, then back to where she started, dissatisfied with her life and love. This all adds to the alarm of dissatisfaction that Is felt. The tragedy In all this Is that she does not Just come full circle but In the process loses her dreams of Independence In the process. She seems to give up. She turned up her coat collar so he could not see that she was crying weakly- Like an old woman† (Steinbeck, 1938). BY Vote assignment, I have found this short story to be fascinating and it brings with it writing and narration. The case presented here falls under the doctrine of Contract Act, 1872 and especially under the provisions regarding breach and remedies for breach of a contract. When the rights and responsibilities arising out of a contract are extinguished, the contract is said to be dissolved or terminated. A contract may be dissolved in any of the following ways: 1. By Agreement: A contract can be terminated by an agreement between the same parties who entered into the contract with mutual agreement. 2. By Performance: As the parties into the contract complete performance of their shares of promises a contract in terminated. 3. By Frustration: A contract can be terminated by the impossibility in the fulfillment of the purpose of the parties in entering into a contract. 4. By Breach: When a contract is not honored by one or more of the parties to the contract by non-performance or interference with the other party’s performance. 5. By Operation on Law: Discharge of a contract by operation of law may occur by merger, by insolvency or by alteration of the written document. In the case in concern, Nike (BD) Ltd. enters into a contract with Sunshine Fabrics for supply of 50,000 pcs of T-shirt as per sample and design. One of the provision/ stipulation of the said contract was that-â€Å"the Sunshine Fabrics would not sell to his other customers for a period of 2 years any T-shirt of the same design and description†. Eventually the said design T-shirt (of Nike) became very popular in Bangladesh and, many retail shops show keen interest to buy them at higher price and as such, Sunshine Fabrics started selling them to different shops ignoring their contract with Nike (BD) Ltd. This is a clear case of breach of contract. A breach of contract is failure to perform as stated in the contract. When a contract is broken the party who suffers on account of it has one or other of the following remedies: 1. Damage: Damages are moneytary compensation allowed to the injured party for the loss or injury suffered by him as a result of the brach of contract. 2. Specific Performance: Specific performance means the actual carrying out of the contract as agreed. 3. Injunction : Injunction is an order of a court restraining a person from doing a particular act. It is a mode of securing the specific performance of the negetive terms of a contrct. 4. Cancellation of the instrument: When there is a breach of contract by one party, the other party may rescind the contract and need not perform his part of obligations under the contract. 5. Rectification of the instrument: When through fraud or mutual mistake of the parties a contract or other instrument in writing does not truly express their intention; either party or his representative in interest may institute a suit to have the instrument rectified. In the case personated Nike (BD) Ltd. s the party who is the sufferer of the breach of contract. Along with damage, Nike (BD) Ltd. can also file a suit for injunction and cancellation of the instrument. The fundamental principle underlying damages is not punishment but compensation. By awarding damages the court aims to put the injured party into the position in which he would have been, had there been performance and not breach, and not to punish the defaulter party. As a general rule, â€Å"compensation must be commensurate with the injury or loss sustained, arising naturally from the breach. Where the party has suffered no damage on account of the breach, the court may still award him nominal damages in recognition of his right. In this case, Nike (BD) Ltd. has suffered an actual loss which arose in the usual course of things from the breach. Thus Nike can claim substantial damage to compensate its suffering. Injunction is a discretionary remedy of the Court. An injunction may be temporary or perpetual. Where a party is in breach of negative term of a contract, the court may, by issuing an injunction, restrain him from doing from what it is promised not to do. Thus injunction is a preventive relief. Since in this case, Sunshine Fabrics is doing an act (selling T-shirts of the particular design) which it promised not to do Nike (BD) Ltd. can file a suit claiming injunction. Along with claiming damages and injunction Nike (BD) Ltd. can also apply for cancellation of the instrument. If one or more of the major provisions of a contract is broken the party suffering from it can apply for cancellation of the instrument. If one or more of the minor provisions is broken the sufferer party can apply for damages but not cancellation of the instrument. In this case Sunshine Fabrics has broken a major provision of the contract. So, Nike (BD) Ltd. can apply for cancellation of the instrument. In reply of Nike (BD) Ltd. ’s legal notice Sunshine Fabrics asserts that the contract which they signed with Nike (BD) Ltd. is, in fact, void, in as much as, the same is in restraint of trade. Sunshine Fabric’s assertion is however unjustified. The agreement stating -â€Å"the Sunshine Fabrics would not sell to his other customers for a period of 2 years any T-shirt of the same design and description† is not in restraint of trade rather merely â€Å"restraining freedom of action†. Thus we can conclude that, every thing else being equal, the case is in very much favor of Nike (BD) Ltd. Sunshine Fabric’s claim of the contract’s being â€Å"void† has no legal grounds. However, if Sunshine Fabrics can anyway prove that its agreement of not selling any T-shirt of the same description to its other customers for a period of 2 years was a minor provision of the contract, Nike (BD) would not be able to cancel the contract but still would be awarded damage and, on the Court’s discretion, injunction.

Fidel Castro's History Will Absolve Me and the Cuban Revolution - Essay Example This paper will address the circumstances surrounding the revolution and Castro’s justification for the revolution. An analysis of Batista’s leadership in Cuba will give grounds on how Castro appeared. Batista started as an army officer but rose up the ladder of ranks in the army with time. He received a commendation from the American government representative that he stood out among the Cubans and possessed a great deal of the ability to rule. This made him realize that he would lead the people in his way. Events led to one another, and eventually in 1942 he won elections and become president. His rule was very oppressive, and he concentrated on maintaining his relationship with the American government but not serving the people1. In 1952, he forcefully grabbed the position of general and imposed himself as a dictator on the Cuban people. This came after signs that he was going to lose an election. Batista’s reign greatly oppressed the people, and he amassed wea lth for himself while the common poverty levels increased among the Cuban people2. Castro and his colleagues rose to fight for change in the society. Castro believed in communism and was determined to change the condition in Cuba. In 1953, he led an attack on the military camp in Santiago3. Together with others who realized the kind of oppression the Cuban people were facing he intended to overthrow the tyrant Batista and establish communism in Cuba. Unfortunately, the attack failed, and the organizers faced the strong vengeance from Batista. A large group of them died in the attack while those who survived ended up in custody. Castro defended the group in court, and only a few of them ended up in jail. However, his own case proved difficult to handle because the justice system denied him the freedom to exercise his rights. The system tried all in its ability to prevent his hearings. In addition, the system did not allow him to have a defending attorney. These situations led to Cast ro writing down a speech that he would use to defend himself because that was the only hope left. On his appearance to court, he delivered the speech â€Å"History Will Absorb Me.† In this speech, he highlighted his justification for organizing the attack. Castro made it clear that his inspiration to fight for the freedom of Cuba came from the Cuban hero Jose Marti4. Marti spent his life advocating the freedom of Cuba and left behind many publications that Castro used for reference. Castro considered Marti his master, as he highlighted in his long speech during the trial. According to Castro, the revolution had all justifications that it would need. The Cuban people were suffering without any intervention from the government. While the Cuban people were perishing in poverty, Batista continued to impose taxes with some aimed at helping America settle its debts. In the speech, Castro elaborated the extreme abuse of power of Batista’s regime. Being a lawyer, he quoted the constitutional clauses that the prosecutor was using against him and declared that none of them described what he had committed. In his explanation, there was no government in Cuba but rather a dictator. The fact that no government existed invalidated the document they called a constitution in all the clauses mentioned5. In addition, Castro introduced his revolutionary vision. He mentioned five laws that he had intended to implement had the revolution succeeded. Violence in the office Essay Review This assignment required me to find an article on violence in the office and write a brief overview of the article using the university library. I will discuss different types of violence that lead to office violence. I will then discuss ways in which a company can control the influences that incite office violence. After reviewing a few different articles I have decided on an article from the university library called† Out of the Shadows,† by Dori Meinert. This article talks about 2 different stories that both deal with physical and mental violence. The stories were not actually based in an office setting, but were based in a home setting (Meinert, 2011). Though once the violence in the home setting was bad enough it spilled into the work place and eventually put the other employees in danger. The article also discussed the role human resources played and discusses how important this department is in any company. It goes into how human resources resolve problems such as domestic violence, and how they can be a great resource in these kinds situation. Human resources have the training, skill set, and ability to keep issue private that helps in instances where there is violence in the work place (Meinert, 2011). With avoidance programs, employee training sessions, and employee assistance programs these will help train and coach employees through and also help them avoid issues such as office violence. Forms of Bullying in the Workplace When it comes to offices violence that could result in bullying there are many different types. In an office setting violence might include a group or person against a peer or someone who reports to another. The violence can be continuous or just conduct that is unreasonable. The majority of the documented instances were management or the administration who perpetrated a number of offenses. The major types of violence include: nonverbal, verbal, embarrassment, physical, and psychological abuse. Examples of verbal abuse  would be name-calling which happens more often than not. A simple phrase calling someone out of there name and cursing are the quickest way to verbally abuse someone and not realize it (Meinert, 2011). In the second story told in the article a women who is abused in her home life seeks refuge at work and tells her co-workers. She felt like she needed to tell someone to get assistance, which in some cases can help. It can actually backfire in some cases. Telling someone your personal business can lead to peers discussing your personal business behind your back spreading rumors, criticizing, or gossiping about your business. Ways to avoid violence in the work place Training employees on office like conduct, creating avoidance plan, and having a zero tolerance policy in place are the main methods to control, avoid, and protect employees against violence in the work place. Keeping the workers trained on up to date procedures and processes is very important. Also making sure managers and human resources are trained on effective communication is also very important. An employee has to trust their manager and if not their manager, than human resources to feel comfortable to talk about issues like violence. Making sure the employees understand that there is an open door policy and that any kind of violence in the work place in not acceptable and will not be tolerated. Most importantly there needs to be an immediate response and rapid results to create a secure environment for all employees.

The Four Elements of Financial Management Financial management is simply put managing the financial aspect of a business. That involves cash coming in and cash going out. There are four elements of financial management which include planning, controlling, organizing and directing, and decision making. These four elements are important and need to be discussed separately. Planning â€Å"The purpose (of planning) is to identify objectives and then to identify the steps required for accomplishing these objectives† (Baker Baker, 2011, p. 5). Planning allows a manager to understand what his or her organization is about, or what it wants to achieve. This stage allows a manager to lay out the basic roadmap for what needs to happen. Kierkegaard and Nietzsche, while both also focus on the meaning of the individual in a worldly setting, approach the problem from a more religious perspective. Kierkegaards view of existence states that the meaningfulness of a human emerges from the conflict of ethics and religious faith. Somewhat of a prelude to the concept of authenticity, Kierkegaard claims that subjectivity is truth, contrasting the objective view of the crowd which would make decisions or view reality based on the social norms of a given age. He feels that an individual seeking truth to their existence through objective science is an individual relieving their self of the burden of being their self. Nietzsches while viewing existence similarly, takes a more nihilistic approach, searching for meaning in the absence or collapse of theism and morality. Avoiding the existence of a norm, he would say that rather than a governing norm setting the standard or pace for the work, the norm should be internal to the work. Since the driving force in the lives of most men is the presence of an intrinsic meaning to life, nihilism could very easily be viewed as a philosophy of despair. Without a given reason to live, many would have no will to live. Nietzsche would see such an individual as weakly constituted, since he feels that the absence of such an intrinsic meaning provides an opportunity for the strong willed or creative individual to create meaning for their self. Where most would view the social norms as the responsibility of anyone in a society, Kierkegaard and Nietzsche would say that one who accepts those social norms is essentially forfeiting his worldly responsibility. With the idea of creating meaning or reason through living life, as opposed to living life for the sake of a given meaning or reason, these philosophers set the stage for the idea to be processed into something more systematic. Moving further into an era of thinking that would finally be referred to as Existentialism rather than bits and pieces of radical thinking, the work of philosopher Jean-Paul Sartre dives deep into the problem of existence. Focusing heavily on the individuals place in the world and giving meaning to the existence of every individual. It states that though the individual is not simply so powerful and meaningful that it transcends this world, the individual is however, transcendent to this world in that the individual has the power to create their own meaning of life while wrapped up in the very act of living it. The governing ideas in existentialism explain that what it means to be human simply cannot be explained, since that meaning is developed during the process of living life as a human. While again, this can be a depressing view since many would prefer to part of a greater whole, or existing for the purpose of a higher potential, it can be interpreted to show that we in fact are the higher potential, since we create our own meaning rather than bend to the will of a predetermined meaning. The human consciousness allows humans to constantly shape their own existence, thus shaping the world around them as they go along. Not only would it be difficult and uncomfortable for a sculptor to sit on his pottery wheel and stare at a lump of clay sitting in a chair as it whirs past his view with every rotation, it would also be very counterproductive. Entities which are not human have fixed properties which define them as well as their value in the world. For instance a stapler is an entity that staples. It was created with the purpose of stapling and its value as an entity lies in how well it can staple. So to staple is the essence of that entity. With such a transcendent ability to choose happiness over sadness, it seems unreasonable to choose to be sad. In this light existentialism can reject negative interpretations of the belief and show itself as humanism. In Sartres work entitled Existentialism is a Humanism he clearly defines ways in which existentialism can be extremely beneficial to humans, rather than a depression lack of reason or meaning for existence. With a race of beings so capable of constantly reinventing their own essence and the ability to make choices from a truly objective view point, limitless possibilities are opened up for the progress of existence. While a lion may not be smart enough to willingly and understanding allow a smarter being to make choices for it, for instance a human cannot reason with a lion why it should stay in its cage or why it should go to school and learn about a given trade so it can make a living later in life, it is also true that a lion cannot make its own choice to not become aggressive when threatened nor can it retain information about computer engineering in a manner which will al low the lion to become a successful computer engineer. The lion can only be forced and trained to work with those around it and it can never work with others for the sake of the benefit of the race as a whole. It seeks only to play out its instincts and desires, without the ability to consciously redirect either of them. In the view of the existentialist, to forfeit subjectivity and choice in order to replace it with following norms or given beliefs, is to forfeit what it is to be human, or according to many philosophers such as Sartre, the burden and responsibilities of being a human.
